Terms & Conditions of Unstructured Supplementary Service Data

  1. These Terms and Conditions are subject to the Memorandum of Association and the Articles of Association of Bank of Khartoum ("the Bank"). The provisions and conditions shall be executed in accordance with the Bank's Memorandum of Association, its Articles of Association, its internal regulations, the internal policies regarding the services provided, the Terms and Conditions for opening Current Accounts, the controls for opening accounts for corporate bodies, organizations, companies, and partnerships affiliated with Bank of Khartoum, its regulations, the fatwa’s (rulings) of the Bank's Shariah Supervisory Board, the regulations, instructions, and directives of the Central Bank of Sudan, and the currently applicable laws of Sudan, to the extent that these Terms and Conditions do not contradict the principles and teachings of Islamic Sharria and the applicable laws.

  2.  This service is subject to the Bank's Mobile Banking Services conditions.

  3. All transactions conducted by customers using their USSD Service  will be subject to monitoring in accordance with the Bank’s AML/CFT Policy. Any deviations or suspicious transactions will be flagged and reviewed accordingly.

  4. The Bank has the right to change any of the provisions and conditions of this document at any time, as well as to amend the services available through it, by deletion, addition, or modification.

  5. The customer acknowledges that this application has been made with their free will and consent, and that the information provided to the Bank is true and authentic. The customer thus bears all banking and legal consequences resulting from obtaining these services in accordance with this document.

  6. The customer agrees that the Bank has the right to close and/or stop and/or freeze the service if it is used illegally and in violation of the provisions and conditions of this document, according to the procedures determined by the Bank from time to time.

  7. The bank may suspend or cancel the USSD Services at any time if misuse or violation of Central Bank of Sudan regulations is detected.

  8. The Bank is not responsible for any delay in the execution or approval of the request under this document for any technical, technological, or any other reasons.

  9. The customer absolves the Bank from any claim and/or liability resulting from the stopping and/or suspension of the service due to any network failures or any other reasons leading to the service stoppage related to any of the service providers.

  10. The customer is obligated to maintain the confidentiality of information and not disclose to any third party their banking information, including the account number, the secret number (PIN/Password), their banking data and transactions, or any other confidential information previously provided to the Bank.

  11. The Bank disclaims its responsibility if the customer uses or discloses their banking information, their "Bankak" account, or password or ‘USSD Services’ by a third party, or if it is used in an unauthorized manner. The customer thus bears any legal consequences resulting from the customer's negligence in safeguarding their account number, password, or other banking information, or if it is used by another party, whether the use is authorized or unauthorized, including submitting an application to obtain any services according to this document.

  12. The Bank shall not be responsible for any losses, damages, or expenses incurred by the customer for any reason, in the event that the customer does not obtain the secret number (PIN/Password) or in the event that the secret number is identified by unauthorized person(s) during delivery or via mail or telephone.

  13. The customer authorizes the Bank to debit from their account any fees or commissions related to the service.

  14. The customer is obligated to notify the Bank immediately in case of updating their data and to provide all required documents by the Bank.

  15. The customer shall indemnify the Bank against all losses, damages, and expenses (including all legal expenses) that may be incurred due to:

  1. Any use, whatsoever, of this service by the customer or any other unauthorized person.

  2. The customer's breach and/or negligence and non-compliance with the terms and conditions mentioned in this document.

  3. The customer shall be solely responsible for all transactions conducted through the service without any liability on the Bank, and the Bank shall be absolved of any responsibility in this regard.

  1. The Bank has the right to terminate the service at any time and without any prior notice to the customer, and also has this right in the following cases:

  1. Closure of the customer's account and/or accounts.

  2. Death of the customer.

  3. Loss of the customer's legal capacity through dissolution, liquidation, and/or bankruptcy.

  4. Misuse of the service.

  1. The customer shall notify the Bank branch where their accounts are held, in writing, requesting temporary suspension of the service. However, the Bank has the right to refuse to suspend the service according to its discretion. If the service is suspended by telephone, the customer is obligated in this case to inform the Bank in writing immediately on the following business day, otherwise the Bank may reactivate the service. This is not exclusive to the following cases:

  1. Use of the secret number (PIN/Password) by a person other than the customer's authorized users.

  2. Loss or theft of the secret number (PIN/Password) or loss of the mobile phone, or if the secret number becomes known to any person other than the customer. The customer shall be responsible for all transactions conducted until the cancellation of the secret number and the service. If the person notifying the Bank is an agent or authorized on behalf of the customer, they must present documents proving the loss or any documents that the Bank may request at that time.

  1. All correspondence and communications from the Bank to the customer shall be sent to the last address provided by the customer to the Bank in writing and shall be considered communicated to the customer on the day it was mailed. It is the customer's duty to immediately inform the Bank in writing of any change in their address; otherwise all correspondence will be sent to the last address and shall be considered legally correct.

  2. The Bank's silence regarding the customer's obligation to adhere to any of the terms and conditions of this document shall not be considered a waiver by the Bank of the unspoken terms and conditions.

  3. I acknowledge that the information mentioned above is true, correct, and up-to-date, and I commit to informing the Bank of any updates to the information. I also acknowledge that I have reviewed all the Terms and Conditions for account opening and the Terms and Conditions for the Account Opening Service.

  4. I do hereby undertake that all above information provided is correct, updated, and I/We confirm that the above information is correct and valid, and I/we pledge to notify Bank of Khartoum immediately of any changes to the above information. I hereby declare that I am the sole beneficial owner of the USSD Services account and that no other party holds or exercises direct or indirect ownership or control over this account.

  5. The Terms and Conditions contained in this document are part of the Bank's Banking Services Terms and Conditions, which are fully available for review on the Bank's website at www.bankofkhartoum.com and its branches across the states of Sudan. The Terms and Conditions contained in the Banking Services Terms and Conditions are considered an integral part of this document, and the Bank has the right to amend these Terms and Conditions from time to time.

  6. My signature on this application constitutes an acknowledgment of my agreement to the Terms and Conditions and that I bear all responsibility in this regard. I also acknowledge that all documents submitted to the Bank are current, correct, and binding. In the event of expiry or incorrectness of any of the submitted documents, it will be my sole responsibility to immediately provide the Bank with updated information from the submitted documents. I further acknowledge absolving the Bank of any liability that may arise from my failure to update the information, and that I bear all responsibility.
